END-USER TERMS AND CONDITIONS

IMPORTANT LEGAL NOTICE: PLEASE READ THIS END-USER TERMS AND CONDITIONS AGREEMENT (THE "AGREEMENT") CAREFULLY. BY TAPPING "ACCEPT," CREATING AN ACCOUNT, ACCESSING THE MOBILE APPLICATION, OR PURCHASING A TICKET VIA THE AXON TICKETS DIGITAL INFRASTRUCTURE (THE "APP"), YOU EXPRESSLY AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS CONTAINED HEREIN.
THIS APP IS OWNED AND OPERATED BY AXON ENTERTAINMENT CORP. (THE "COMPANY"). IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY TERMINATE YOUR USE OF THE APP AND UNINSTALL IT FROM YOUR DEVICE.
1. DEFINITIONS AND PLATFORM INTERPRETATION
"Company" refers to Axon Entertainment Corp., its subsidiaries, directors, officers, and developers.
"App" / "Platform" refers to the Axon Tickets mobile application, web application, digital ticketing engine, and scanning infrastructure.
"Host" / "Organizer" refers to the third-party event producer, promoter, or venue entity using the App to list and sell tickets.
"User" / "You" refers to any individual who downloads, registers, or transacts on the App.
"Ticket" refers to the unique, system-generated digital QR code or barcode issued through the App.
2. ACCOUNT CREATION, SECURITY, AND LICENSE
Account Responsibility: You are entirely responsible for maintaining the confidentiality of your in-app login credentials. Any transaction executed through your registered account will be legally deemed as executed by you.
App License Grant: The Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on personal mobile devices strictly for personal, non-commercial use.
3. PLATFORM FEES AND TRANSACTION ARCHITECTURE
Non-Refundable Platform Fee: For every individual Ticket successfully processed, checked out, or reserved through the App, a non-refundable Platform Fee of Fifty Pesos (PHP 50.00) shall be levied on top of the base ticket price set by the Host.
Earned Fees: This fee is permanently earned by the Company at the immediate point of transaction to cover digital bandwidth, security pipelines, and in-app transaction processing.
4. CREDIT AND DEBIT CARD TRANSACTIONS & SECURITY
Third-Party Payment Gateways: Axon Tickets utilizes secure, industry-standard, PCI-DSS compliant third-party payment processors and gateways (e.g., Maya, Stripe, Dragonpay) to clear credit and debit card transactions.
Data Security Isolation: The App does not directly store, process, or maintain your full card numbers, CVV codes, or card expiration details on our local servers. All card data is encrypted and transmitted directly to the authorized payment gateway.
Cardholder Authorization Warranty: By submitting credit or debit card information through the App, you explicitly warrant that you are the lawful owner of the card or possess absolute, explicit authorization from the primary cardholder to execute the transaction.
Billing Execution: Your card will be billed immediately upon tapping "Pay Now" or completing the biometric authentication prompt in-app. The transaction amount will comprise the base event ticket price plus the non-refundable PHP 50.00 Platform Fee.
Currency and Bank-Level Conversion Fees: All transactions processed via Axon Tickets are denominated strictly in Philippine Pesos (PHP). If you utilize an international or foreign-currency credit/debit card, you acknowledge that any foreign exchange conversion fees, cross-border transactional surcharges, or assessment fees levied by your issuing bank are your sole financial responsibility.
Failed Transactions and Floating Charges: In the event of an internet disruption or payment gateway timeout where funds are deducted from your bank account but no digital Ticket QR code is generated by the App, the transaction is deemed uncompleted and will not clear into Axon Tickets' account. The deducted amount represents a temporary banking hold or "floating charge" initiated by your issuing bank. The reversal of these funds back into your card or account balance is subject entirely to the clearance timeline of your local bank (typically 3 to 15 business days for debit cards, or the next billing cycle for credit cards). The Company shall not be held liable for bank-level processing delays.
5. CANCELLATION, POSTPONEMENT, AND REFUND ARCHITECTURE
Host-Driven Recourse: Axon Tickets functions strictly as an intermediate technological marketplace. All refund requests, event cancellations, or payout claims must be negotiated and settled directly with the designated Host/Organizer of the event. The Company is under no obligation to disburse corporate funds to satisfy Host cancellation liabilities.
Exclusion of Fees: If a Host authorizes a refund due to event cancellation or scheduling issues, the disbursed amount to the User shall strictly exclude the PHP 50.00 Platform Fee.
Emergency Rescheduling: If an event is postponed or rescheduled due to severe weather, force majeure, acts of God, or unexpected local government restrictions, all issued digital QR/barcodes will automatically remain valid and roll over to the newly designated date or alternate venue selected by the Host. If you cannot attend the newly rescheduled date, any alternate remedies or credit vouchers must be processed strictly through the specific event policies of the Host.
6. ANTI-RESALE AND ANTI-SCALPING PROTECTIONS
Commercial Resale Prohibition: Tickets purchased within this App are intended strictly for personal use. The commercial resale, re-marketing, or "scalping" of tickets at a premium price higher than the original face value is strictly prohibited.
Automatic Voidance: The Company reserves the absolute right to track, invalidate, and completely deactivate any digital barcode found to be listed on secondary unauthorized resale marketplaces or scalping networks without prior notice and without any obligation to issue a refund.
7. FRAUD PREVENTION AND CARD DEACTIVATION
Fraud Detection Monitoring: The App employs automated risk analysis tools to flag fraudulent payment methods. The Company reserves the unilateral right to freeze or cancel any transaction suspected of utilizing unauthorized financial pipelines.
Immediate Deactivation: If a banking institution or mobile wallet provider flags a transaction as fraudulent or initiates a bad-faith chargeback dispute post-purchase, the App will immediately and automatically deactivate all associated digital Ticket barcodes.
Ecosystem Blacklisting: Users associated with fraudulent payment claims will be permanently blacklisted and blocked from executing future transactions across all software applications powered by Axon Entertainment Corp.
8. DATA PRIVACY, SHARING, AND MARKETING CONVENTIONS
Host Data Access: By registering for an event via the App, you explicitly acknowledge and agree that your registration parameters (Name, Email, Mobile Number) will be securely shared with the specific Event Host/Organizer for check-in validation and on-site logistics.
Separate Marketing Opt-In: In strict compliance with the Philippine Data Privacy Act of 2012, your data will not be automatically funneled into promotional streams. Users must toggle a separate, explicit in-app marketing opt-in checkbox to receive promotional updates, offers, or newsletters from the Company or its commercial partners.
9. VENUE ADMISSION, SECURITY, AND USER CONDUCT
Absolute Right of Refusal: Possession of an in-app Ticket does not guarantee entry if you violate venue safety codes. The Host, venue management, and on-site security personnel retain the absolute right to refuse entry or eject any individual who is intoxicated, displaying unruly behavior, or violating local venue laws, without any obligation to issue a refund.
Optional ID Verification: To combat identity fraud and unauthorized device sharing, security gates may request you to present a valid government-issued ID matching the registered name on the App's digital ticket interface. Failure to match registration details may result in a denial of access to the venue.
10. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed, interpreted, and enforced strictly in accordance with the laws of the Republic of the Philippines. Any legal actions or disputes arising from your use of the App or transactions processed herein shall be filed exclusively before the proper courts of Davao City, Philippines.
